The irritants betweeen the judiciary and the excecutive

Justice Ajit Praksh Shah in his article ,in the Hindu  ‘’The attack on  the last bastion  of judiciary’’ is fully echoing the worry of the civil society, the academicians, historians, media and the honest politicians over the verbal exchanges between the judiciary , particularly the supreme court and the executive. The news following  public are aware of  the helplessness  of the supreme  court over the practical difficulties it encounters due to the delayed approval granted by the executive to the list of judges sent by the collegium.

 When  we have been  observing in recent decade all the attempts taken to kill one by one all the institutions  of democracy , any  attempt to tame or silence the judiciary too will become an additional and serious worry , because the general public have pinned their faith only on judiciary  for final justice in all types of disputes .If the judiciary accepts the criticism of lack of accountability and transparency in collegium appointment of judges and if the executive  accepts and understands  the hurdles it creates for the SUPREME COURT’S  efficient functioning by delayed approval of judges , both should try to sort out the hurdles in a mature and responsible way for the way of coordinated functioning  of the judiciary and executive . .

gender budgeting

 

All the departments in Tamil Nadu ‘’to formulate gender budget’’ is a welcome news  especially when India has ranked 135out of 146 countries as per the report of world economic forum -2022. Focus of Tamil Nadu gender budgeting  should be on  giving budgetary provision  for graduate girls to undergo job  oriented certificate courses  which would enable more girls to enter into organised job sector and to give basic training  to women presidents in local administrative units . At the current rates of progress, it will take 155 years to close the political empowerment gender gap -- 11 more than predicted in 2021 -- and 151 years for the economic participation and opportunity gender gap. Hence ,concentration is needed in these two fields.

Indias way of celeberating 75th Independence Day

“ 14 persons were killed , a pregnant woman and a several other women were raped and a 3 year old had her head smashed to the ground. “ To  visualize these gruesome and heart less acts even  after 20 years make our hearts bleed and put our heads in shame. To our horror,  the 11 persons identified as perpetrators of this horrific crime were released on August 15th  after  remission was granted to all of them and they were all given ceremonial welcome. None of them had remorse on their faces and rather they were well dressed and receiving the honours done to them  like war heroes . The day India was celebrating the  75th Independence day , the victims lost their  independence to live with dignity and live without fear for their families safety . On the one hand grand speeches on women safety and dignity are screamed  and on the other hand efforts were taken to  help crime doers against women by choosing remission policy of 1992 . let us see whether the petition to challenge the offenders release will bring justice to the victims ,

“Class 12 girl found dead in school  hostel “  is the news  bit on first page of The Hindu 9(26.7.22)slapping on our face . As usual the “police Suspects it to be a case of suicide. “It looks as though Tamil Nadu would soon earn the    distinction of  getting first rank in teenage girls suicide . We do not know whether the agony of the families , worry of the civil society and the fellow students fear about their future shakes the collective consciousness of the stake holders of school education sector. For them it seems to be another addition  of death added to the existing data of teenagers suicides or murders. Our administrators seem to think that, consolation , cash  compensation  and extensive media coverage would please and calm down the parents .

 When will the school education ministry come out with most effective , urgent  and concrete steps to arrest the suicidal  tendency among youngsters? When will they give the teachers training in  identifying  the students distress and offer counseling ? When will the school education department undertake a thorough inspection of the school hostels and  take  steps to eliminate erring hostels and when will the CBSC schools brought under  the inspection of the state authorities ? When will government schools  standards upgraded so that , poor students are not lured towards heartless private schools ?

governor of Tamil Nadu

Ever since Governor of Tamil Nadu R.N.Ravi occupied his position in this state, he  has concentrated  more on propagation of his personal political and religious ideologies  among the youth of Tamil Nadu  by visiting educational institutions  since his targeted audience is youth of this state who are used to different principles of political thought. He has more important constitutional duties to attend to.  For example ,  every bill passed by the state legislature will become law only after his signature. But, when a bill is sent to the Governor after it is passed by the legislature, he has the option to give his assent to the bill or withhold his assent to the bill or return the bill for the reconsideration of the legislature. But Tamil Nadu Raj Bhavan is sitting  over 21 bills for a long time . All Bills passed by the state legislature are for the welfare of the state of Tamil Nadu. The governor’s action will paralyse the administrative functions of the state . We do not understand why the government of Tamil Nadu is exercising  extra ordinary patience in this matter without using  guidance given through   the recent supreme court’s observations regarding  governors non cooperation in signing of bill passed by the elected members of the state legislatures
